12. Original Artwork Purchases
Original paintings are unique, individually created works of art.
I make reasonable efforts to represent artwork accurately through photographs, descriptions, dimensions, and other available information.
Colors may appear slightly different depending on the lighting, monitor, or device used to view the artwork.
Original paintings may contain visible brushwork, textures, palette knife marks, and other characteristics that are intentional parts of the artistic process.
Availability is subject to confirmation. If an artwork is unavailable after an order is placed, I will contact the purchaser and arrange a refund.
Purchase of original artwork and prints transfers ownership of the physical painting and print but does not transfer copyright, reproduction, or licensing rights unless expressly agreed in writing.
13 Errors & Omissions:
Every effort is made to provide up-to-date, accurate information both on the Site and through our services. However, Holly Hunter Berry does not and cannot warrant, represent, or guarantee that such information is free from errors, accurate, or up-to-date at all times. You should do your due diligence, research, or consult with a professional to ensure that all information you receive, act upon, or rely on from this Site and/or from our services is accurate and up-to-date.
14. Shipping and Delivery
Original artwork is shipped only to addresses within the contiguous 48 United States.
Standard shipping and handling are generally included in the listed artwork price unless otherwise disclosed before purchase.
I select the shipping carrier based on the artwork's size, packaging requirements, destination, and other practical considerations. Carriers may include FedEx, UPS, or USPS.
Expedited shipping may be available by special arrangement. Any additional charges will be discussed and approved before purchase.
Certain oversized or unusually difficult-to-ship artworks may require individual shipping arrangements, which will be communicated before the purchase is finalized.
I take reasonable care in preparing and packaging original artwork for shipment.
Shipping and delivery times may vary. I will communicate significant delays and provide appropriate cancellation or refund options as required by applicable law.
If artwork arrives damaged, please contact me promptly and retain the original packaging. Photographs of the artwork and packaging may help document the problem and assist in resolving it.
15. Original Artwork Returns and Refunds
I want collectors to be pleased with their original artwork purchases.
For original artwork purchased online through www.hollyhunterberry.com, return requests may be made within seven (7) calendar days of delivery.
To request a return, please contact me through my website before shipping the artwork back.
For change-of-mind returns:
- The artwork must be returned in its original, unaltered condition.
- The buyer is responsible for return shipping costs, including tracking and adequate insurance.
- Original packaging should be retained and used whenever possible.
- Return shipping instructions will be provided after the request is approved.
- The artwork must be shipped back within seven (7) calendar days after the return instructions are provided.
Once the returned artwork has been received and inspected, a refund of the purchase price will be issued promptly through the original payment method when possible, or through another agreed method.
Original artwork purchased in person is generally considered a final sale for change-of-mind purposes unless otherwise agreed in writing.
If artwork arrives damaged, is incorrectly supplied, or is materially different from its description, please contact me promptly so that an appropriate resolution can be arranged.
Nothing in this policy limits any consumer rights or remedies provided by applicable law.
16 Fine Art Prints
Fine art prints and reproductions may be purchased through GeoGalleries, a separate website linked from HollyHunterBerry.com.
Purchases made through that website are subject to the applicable ordering, payment, production, shipping, and return arrangements disclosed for those transactions.
Customers should review the information provided through GeoGalleries before purchasing prints.
17. Adult Art Classes and Educational Offerings
I offer in-person art instruction primarily for adults aged 18 and older.
My website may provide information about regular classes, educational opportunities, and future workshops or special events.
Regular in-person classes are arranged and paid for separately rather than through the website's online artwork checkout.
Applicable class schedules, fees, attendance arrangements, and other relevant information are communicated during enrollment.
Workshops, paint parties, and additional educational offerings may be introduced in the future. Any specific registration, payment, cancellation, and refund terms will be provided before registration or purchase.
Class content, demonstrations, schedules, or materials may occasionally change for reasonable educational or practical purposes.
Students are expected to follow reasonable safety instructions and manufacturer recommendations when using art materials and equipment.
18. Student Artwork and Commercial Use
I encourage students to develop their artistic abilities and to share their creativity.
Students are welcome to display, exhibit, give away, and sell paintings they personally create while following my instructional demonstrations, subject to any applicable third-party copyright or intellectual property rights.
Students are not required to pay me a commission or royalty for the sale of their own paintings created through my demonstrations.
This permission does not authorize reproduction of my original artwork, redistribution of my instructional materials, or unauthorized commercial use of copyrighted photographs and other protected materials.
Students are responsible for ensuring they have the appropriate rights to use any reference images for their intended purposes.

19. Copyright and Intellectual Property
Unless otherwise stated, the original artwork, photographs, written educational materials, instructional videos, graphics, website content, and other original creative materials produced by Holly Hunter Berry are protected by applicable copyright laws. See my copyright statement
Website content may be viewed for personal, noncommercial purposes.
Links to publicly available website pages may be shared.
Unless written permission has been granted or applicable law otherwise permits, website content and instructional materials may not be copied, reproduced, republished, distributed, or sold in ways that infringe the copyright owner's rights.
Purchasing original artwork, prints or instructional materials does not automatically grant permission to reproduce or commercially distribute the underlying copyrighted content.
20. Student Privacy, Artwork, and Testimonials
I respect the privacy and creative work of students and customers.
Students retain applicable ownership rights in artwork, photographs, and other original materials they submit for instructional feedback.
Submitting artwork for instruction does not automatically authorize its public use in advertising, promotional materials, or social media.
I may request permission before publicly sharing student artwork, photographs, or testimonials.
If future online educational sessions are recorded, applicable recording and participation arrangements will be communicated in advance.

21. Payments and Pricing
Prices for original artwork are displayed on the website or otherwise communicated before purchase.
Depending on the transaction, available payment arrangements may include PayPal, Zelle, cash, or checks.
You will receive an electronic receipt following your Purchase, which you should retain for your records.
Not every payment method is necessarily available for every transaction.
Online payments may be handled through independent payment service providers, which have their own terms and privacy practices.
Payment processing companies may have different privacy policies and practices than we do. We are not responsible for the policies of the payment processing companies. As with any online purchase, there are circumstances beyond our control which may compromise your credit card or payment method. We are not liable or responsible for any of those circumstances.
You hereby release us from any and all damages related to your payment or use of our payment processing companies in which you incur and further agree not to assert any claims against us or them for any damages which arise from your Purchase or use of our Site and its Content.
Applicable sales taxes or other disclosed charges may be added where required.

Individual artistic progress varies depending on experience, practice, personal goals, and other factors.
No particular artistic result, professional recognition, artwork sale, or financial outcome is guaranteed.
23. Respectful Participation and Website Use
I strive to maintain a welcoming, respectful, and encouraging environment.
Website visitors and participants in educational offerings are expected to respect others and refrain from harassment, threatening conduct, unlawful activity, infringement of intellectual property rights, and attempts to interfere with website security or operation.
I may reasonably restrict participation or access when necessary to address serious misconduct or violations of applicable terms, while respecting any legal obligations concerning paid products or services.
